Membership Terms of Use for All Home Services
Effective Date and Acceptance
These Membership Terms of Use apply to All Home Services memberships and maintenance plans. Before joining, review your selected plan, enrolled property, included benefits, service-value schedule, payment choice and exact charges. To enroll, you must actively accept the 12-month commitment, automatic annual renewal, 30-day cancellation notice, $199 early-cancellation fee and repayment of uncovered membership service usage after early cancellation or nonpayment. You must also separately authorize the selected recurring payments. These choices are not preselected and are separate from optional marketing consent. A record of the terms, plan, price and billing choice you accepted will be retained with your enrollment. Viewing this page or submitting a service inquiry does not enroll you or authorize payment.
Membership Eligibility
Membership is subject to approval by All Home Services and may require an initial property or system evaluation. Eligibility depends on service location, property condition, equipment condition, accessibility, safety, and the requirements of the selected plan. All Home Services may decline enrollment, require corrective work before enrollment, or limit certain membership benefits when conditions are unsafe, inaccessible, unsuitable, or outside the scope of the selected plan, subject to applicable law. Enrollment does not guarantee that any pre-existing condition, defect, or previously damaged system will be covered.
12-Month Term, Billing and Automatic Renewal
Each membership has a 12-month initial term and automatically renews for successive 12-month terms unless All Home Services receives a cancellation or nonrenewal request at least 30 calendar days before the current term ends. Monthly billing means 12 monthly installments for each annual term; it is not a month-to-month membership. You may instead pay for all 12 months in one advance payment and receive 10% off the total of 12 monthly membership payments. The annual amount is calculated as the approved monthly membership price multiplied by 12, less 10%, rounded to the nearest cent. The selected payment schedule continues at each annual renewal unless changed by agreement. Before signup, you will see the enrolled property, selected plan, payment frequency, exact payment amount, term dates, renewal date and cancellation deadline. Recurring payment authorization and acceptance of the applicable membership terms are required before enrollment and charging. Price changes will be communicated as required by applicable law.
Cancellation
Give All Home Services at least 30 calendar days' notice of cancellation. To prevent automatic renewal, your request must be received at least 30 calendar days before the current 12-month term ends; the membership then ends at the close of that term. You may send a cancellation request to service@allhomeservicesllc.com and identify the member and enrolled property. If you end the membership before the current 12-month term is complete, a $199 early-cancellation fee applies in addition to any service-usage repayment described under Payment and Membership Status. All Home Services will provide an itemized calculation showing services used, membership payments credited and amounts due. Any cancellation right, notice requirement or refund required by applicable law will be honored. If you cancel a prepaid membership before its current 12-month term ends, unused prepaid months are refundable after deducting the $199 early-cancellation fee and applicable uncovered service-usage repayment. The itemized settlement will show the refund credit, deductions and resulting refund or balance due.
Membership Benefits and Service Limitations
Membership provides only the services and benefits specifically listed in the customer’s selected plan or written service agreement. Membership does not provide unlimited repairs, replacement coverage, insurance, or guaranteed coverage for every failure or condition. Inspections and preventive maintenance do not guarantee that equipment, electrical systems, plumbing systems, HVAC equipment, or other property components will not fail in the future. Repairs, replacements, parts, materials, additional labor, and services outside the selected plan require separate authorization and may result in additional charges. All services remain subject to accessibility, safety, equipment condition, service availability, and applicable legal requirements.
Payment and Membership Status
Membership benefits are available only while the membership is active and payments are current. Benefits may be suspended for failed or overdue payments. If you cancel early or fail to pay, you must repay the positive difference, if any, between the normal nonmember prices of membership-included services actually used during the current 12-month term and membership payments actually received and credited to that term. Service values and the calculation method must be disclosed in your enrollment agreement before you accept and pay. The usage repayment cannot be less than zero. Services you separately paid for are not charged again as membership usage, and payments are not credited or collected twice. The $199 fee applies to early cancellation and is separate from this usage calculation. An itemized reconciliation will be provided; this clause does not itself authorize a new automatic card charge for a disputed or unreviewed balance. Any legally required credits, refunds and consumer rights remain available.
Pre-Existing and Hidden Conditions
All Home Services is not responsible for pre-existing defects, concealed damage, code violations, improper prior work, inaccessible components, manufacturer defects, or conditions that could not reasonably be discovered during a normal inspection or service visit. If additional problems are discovered, any extra diagnosis, repair, replacement, materials, permits, or labor must be separately approved and may result in additional charges. Nothing in this section limits responsibility for damage directly caused by work performed by All Home Services where liability cannot legally be excluded.
Customer Responsibilities
Customers must provide accurate information about the property and known problems, provide safe and reasonable access to the work area, and ensure access to necessary utilities and equipment. Customers must disclose known hazards, unsafe conditions, prior repairs, or other information that could affect the work. The customer is responsible for obtaining any required property-owner, landlord, HOA, or other third-party permission before service when applicable. All Home Services may delay, reschedule, limit, or refuse service when access is unavailable, conditions are unsafe, required information is withheld, or the requested work is outside the agreed scope, subject to applicable law.
Access, Openings, and Restoration
Some diagnostic, maintenance, repair, or installation work may require reasonable access through walls, ceilings, floors, cabinets, crawlspaces, attics, landscaping, concrete, or other finished areas. By authorizing the work, the customer authorizes reasonable access necessary to reach the applicable equipment, wiring, piping, ductwork, or other systems. Unless specifically included in the approved written scope of work, patching, painting, drywall repair, carpentry, cabinetry, tile, flooring, masonry, concrete, landscaping, or other cosmetic or finish restoration is not included and may require separate authorization, charges, or another contractor. All Home Services will use reasonable care when accessing concealed systems but is not responsible for unavoidable cosmetic damage resulting from reasonably necessary access, except to the extent liability cannot legally be excluded or limited.
Hazardous Materials and Unsafe Conditions
All Home Services may delay, suspend, limit, or refuse work when conditions at the property are unsafe or may expose workers or others to hazardous materials or dangerous conditions. This may include suspected asbestos, lead, mold, sewage, contaminated materials, chemicals, pests, unsafe electrical conditions, gas leaks, structural hazards, standing water, fire hazards, aggressive animals, or other unsafe conditions. All Home Services is not responsible for testing, identifying, removing, containing, or remediating hazardous materials unless that service is specifically included in a separate written agreement. Any required testing, remediation, specialty contractor work, additional protective measures, or return visits may result in additional charges and must be separately authorized. Nothing in this section limits liability that cannot legally be excluded.
Emergency Conditions and Immediate Safety Actions
Membership does not guarantee emergency response, immediate dispatch, or 24-hour availability unless specifically stated in a separate written agreement. If a condition presents an immediate threat to life, health, property, fire safety, electrical safety, gas safety, flooding, or another serious hazard, the customer should contact the appropriate emergency service, utility provider, or other qualified emergency resource when necessary. All Home Services may recommend that equipment or systems remain shut down or out of service until they can be safely evaluated or repaired. Any emergency, after-hours, temporary, or additional work outside the selected membership plan may require separate authorization and additional charges.
Separate Authorization for Repairs and Additional Work
Membership enrollment does not automatically authorize repairs, replacements, installations, upgrades, parts, materials, additional labor, or other work outside the services specifically included in the selected membership plan. Additional work must be separately approved by the customer before it is performed, except when immediate action is reasonably necessary to prevent an imminent safety hazard and applicable law permits such action. Any separately authorized work may be subject to additional charges, estimates, invoices, service terms, warranties, or written agreements. Declining recommended work does not make All Home Services responsible for future damage, failure, deterioration, or other consequences resulting from the unresolved condition, except where liability cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, All Home Services is not responsible for indirect, incidental, special, consequential, lost-use, lost-profit, business-interruption, or similar damages arising from equipment or system failure, pre-existing or concealed conditions, utility interruptions, manufacturer or third-party failures, customer-supplied equipment, delays outside All Home Services’ reasonable control, or work outside the approved scope. Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any other liability that cannot legally be excluded or limited.
Warranties
Any warranty provided by All Home Services applies only when specifically stated in writing for the particular service, repair, installation, part, or equipment involved. Membership enrollment by itself does not create any additional warranty or guarantee that equipment or systems will remain free from future failure. Manufacturer warranties are governed by the manufacturer’s own terms. Warranty coverage may not apply to problems caused by misuse, neglect, alterations or repairs by others, pre-existing conditions, customer-supplied equipment, manufacturer defects, utility issues, or conditions outside All Home Services’ reasonable control. Nothing in these Terms limits any warranty or consumer right that cannot legally be waived.
Scheduling and Delays
Membership does not guarantee same-day service, emergency service, or a specific response or completion time unless expressly stated in the selected plan or a separate written agreement. Scheduling depends on technician availability, service location, weather, parts and equipment availability, utility coordination, inspections, permits, emergencies, and other conditions outside All Home Services’ reasonable control. All Home Services may reschedule or delay service when reasonably necessary. Delays caused by third parties or circumstances outside the company’s reasonable control do not create a right to additional membership benefits or compensation, except as required by applicable law.
No Transfer of Membership
Membership benefits apply only to the customer, property, account, or location identified in the applicable membership plan or service agreement. Memberships and unused benefits may not be transferred, assigned, sold, shared, or applied to another person, property, business, or location without prior written approval from All Home Services. A change in property ownership, tenancy, management, or account holder does not automatically transfer the membership or its benefits. Any approved transfer may be subject to eligibility review and updated plan terms.
Entire Agreement and Written Changes
These Membership Terms, the selected membership plan, any applicable proposal or scope of work, and any separately signed service agreement make up the agreement between the customer and All Home Services regarding the membership or covered services. Verbal statements, advertisements, estimates, emails, text messages, or other communications do not modify the agreement unless the change is confirmed in writing by All Home Services. If a separately signed agreement conflicts with these general Membership Terms, the separately signed agreement controls for that specific customer and service.
Severability
If any provision of these Membership Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be enforced to the maximum extent legally permitted or, if necessary, removed without affecting the validity or enforceability of the remaining provisions. The rest of these Terms will remain in full force and effect.
Texas Law / Governing Law
These Membership Terms are governed by the laws of the State of Texas, except where applicable federal law or another law legally controls. Nothing in these Terms is intended to waive or limit any consumer right, remedy, protection, or liability that cannot legally be waived or limited.
Changes to Membership Plans and Pricing
All Home Services may update membership pricing, plan benefits, included services, exclusions, or other plan terms when reasonably necessary. Any material change affecting an active recurring membership will be communicated before it takes effect as required by applicable law. Changes will not retroactively alter charges or services already completed. Customers may cancel their membership according to the applicable cancellation terms if they do not wish to continue under revised terms. Membership upgrades take effect immediately with a prorated charge. The new plan, effective date, prorated charge and ongoing payment amount must be shown for customer approval before the change is applied.
Contact and Notices
Questions, cancellation requests, billing concerns, or other notices regarding a membership should be submitted using the contact methods provided by All Home Services. Customers are responsible for keeping their contact and billing information current. Notices sent by All Home Services to the email address, phone number, mailing address, or other contact information provided by the customer will be considered delivered as permitted by applicable law.
Discounts and Member Benefits
Membership discounts, priority scheduling, included visits, service credits, and other benefits apply only when specifically stated in the selected membership plan or written service agreement. Benefits may be subject to exclusions, service limits, availability, and other plan-specific conditions. Discounts do not apply retroactively to previously completed work and cannot be exchanged for cash. Membership benefits may not be combined with other promotions or discounts unless All Home Services specifically approves it. Parts, materials, equipment, permits, third-party charges, and work outside the membership scope are not discounted unless the selected plan expressly states otherwise.
Missed or Rescheduled Appointments
Customers should provide reasonable notice when an appointment must be changed or canceled. If All Home Services cannot access the property at the scheduled time, or if the customer is unavailable when access is required, the visit may need to be rescheduled. Repeated missed appointments, denied access, or last-minute cancellations may affect scheduling priority or membership benefits when permitted by the applicable plan and law. Any fee for a missed or canceled appointment will apply only if it was clearly disclosed to and accepted by the customer in advance.
Customer-Supplied and Third-Party Equipment
All Home Services is not responsible for defects, failures, incompatibility, missing components, manufacturer issues, software or firmware problems, or improper prior installation involving equipment, fixtures, parts, or devices supplied by the customer or another third party. Additional labor, materials, troubleshooting, modifications, or replacement needed because of customer-supplied or third-party equipment may result in additional charges and must be separately authorized. Manufacturer warranties remain subject to the manufacturer’s terms. Nothing in this section limits responsibility for damage directly caused by work performed by All Home Services where liability cannot legally be excluded.
Permits, Inspections, Utilities, and Code Requirements
Some projects may require permits, inspections, utility coordination, code corrections, or other approvals depending on the work and local jurisdiction. Unless specifically included in the approved scope, permit fees, inspection fees, utility charges, code-required upgrades, and additional work are not included in the membership price and may result in additional charges. All Home Services is not responsible for delays caused by permitting authorities, inspectors, utility providers, manufacturers, weather, or other circumstances outside its reasonable control. Any additional work required to complete the project safely or in compliance with applicable requirements must be separately authorized.
Termination of Membership
All Home Services may suspend or terminate a membership for nonpayment, fraud, misuse of membership benefits, abusive or threatening behavior, unsafe working conditions, repeated failure to provide access, unauthorized chargebacks, material violations of these Terms, or other circumstances that make continued service unreasonable or unsafe. Termination does not eliminate amounts already owed for services performed, materials provided, or other authorized charges. Any refund or notice required by applicable law will be provided.
Business Maintenance Plans and Commercial Accounts
Business, commercial, multi-location, landlord, property-management, and other non-residential maintenance plans may be customized based on the property, services requested, service frequency, locations, operating conditions, and maintenance needs. Specific services, labor allowances, pricing, exclusions, response expectations, and other terms will be stated in the applicable proposal, scope of work, or written service agreement. If a separately signed commercial service agreement conflicts with these general Membership Terms, the separately signed agreement will control for that customer and service. Services not specifically included in the approved commercial agreement are outside the plan and may require separate authorization and additional charges.
